Most Lenders require borrowers to purchase title insurance to protect the Lender's investment in the property being purchased or refinanced. The purpose of the title insurance policy is to protect the Lender and/or the Buyer against loss from mistakes which could have occurred in the abstract of title and claims which cannot be discovered by an examination of public records.

Such mistakes include:

  • Fraudulent representations
  • Undisclosed or missing heirs
  • Invalid divorces
  • False affidavits
  • Liens involving judgments and contractors
  • Unpaid taxes
  • Mistakes in recordings and title searches
  • Defective foreclosures or tax sales
  • Deeds executed under a defective power of attorney
  • Clerical errors in the land records

    Most attorneys do not begin title work in real estate transactions until the buyer/borrower receives loan commitment from the Lender. The reason for this is that attorneys do not want the buyer/borrower to incur the cost of abstracting and title insurance until they are sure that the Lender will guarantee the loan. As a service to our clients, the attorneys at The Law Offices of Joseph T. Cardany normally begin title work well before the commitment is received from the Lender to expedite the title process so that the title insurance required by the Lender is in place when commitment is received. This service often allows us to close transactions up to two weeks earlier than average, and allows our clients to get into their new homes quicker. As an added service to our clients, we absorb the cost of the title work if the transaction does not close and there is no cost to the client.
